This privacy policy describes how ArtSquare, LLC, ("us", "we", or "ArtSquare") collects and uses the personal information you provide on our Web site at and its subdomains (the "Site"). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. By using, accessing, or participating in the Site or Services, you agree to the terms of this Privacy Policy. Capitalized terms not defined in this Privacy Policy have the meanings stated in the Terms of Use.

We collect information that is relevant to the Site or Services. This information allows us to provide you with a customized and efficient experience. We collect the following types of information from our ArtSquare users: (i) information you provide to us via the Site or Services and (ii) information about your use of the Site and the Services collected by us as you interact with the Service.

We receive and may store any information you enter on our Site or provide to us in any other way. You can choose not to provide us with certain information, but then you may not be able to take advantage of certain features of the Services.

Registration: In order for you to use ArtSquare's Services you must complete a registration form. As part of this registration form, we require select personal information, such as your e-mail address, date of birth, legal name, location information (such as your mailing address or ZIP code), and brief biographical information for your User Profile.

User Profile: To allow you to express yourself beyond just the information collected during registration, we enable you to provide additional information, such as a bio, favorite URLs, and instant messaging IDs. In addition, you may choose to include photos of yourself in your profile. As indicated below, in the section titled "Sharing Your Information", you can control how your information is displayed and used.

We receive and store certain types of information whenever you interact with us, the Services, or the Site. ArtSquare and its authorized agents automatically receive and record certain "traffic data" on their server logs from your browser, including your IP address, ArtSquare cookie information, and the page you requested. ArtSquare uses this traffic data for purposes such as helping to diagnose problems with its servers; analyzing trends; providing, administering, and improving the Site and Services; providing customer support' gathering statistical information for aggregate use; and customizing users' experiences.

ArtSquare may collect and, on any page, display the total counts that page has been viewed. This includes User Profile pages.

Many programs are available that help you to visit Web sites anonymously. While ArtSquare will not be able to provide you with a personalized experience if we cannot recognize you, we want you to be aware that these programs are available.

ArtSquare will not provide your e-mail address to a third party without your explicit permission, except in connection with providing the Services, as detailed in the "Sharing Your Information" section below. ArtSquare may send out e-mails with ArtSquare-related news, products, offers, surveys or promotions. You may also receive notification e-mails from ArtSquare, which inform you of actions (such as friend requests) that have been performed on the Site. If you do not want to receive e-mail from us, please visit the E-mail Preferences section of your User Profile and/or follow the instructions contained in the unwanted e-mail message. However, please note that in all cases you will continue to receive all system e-mails (such as those regarding forgotten user passwords) and legal notices (such as updates to our policies) from us.

Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser to enable our systems to recognize you and tell us how and when pages in our Site are visited and by how many people. ArtSquare uses both session and persistent cookies. ArtSquare may use session cookies to collect personal information, and we may combine information collected through cookies with other personal information to tell us who you are or what your screen name or e-mail address is.

The "help" menu on most browsers will explain how to prevent your browser from accepting new cookies, how to configure the browser to tell you when you receive a new cookie, or how to fully disable cookies. We recommend that you leave the cookies activated for our Site because cookies allow you to use some of ArtSquare's coolest features. Some of our business partners may use cookies on our Site. We have no access to, or control over, these cookies.

Because ArtSquare enables people to discover and share information with one another, information about the people who use ArtSquare is an integral part of the ArtSquare experience. Except in accordance with this Privacy Policy, we neither rent nor sell your personally identifiable information to anyone, and we will share your personally identifiable information only as described here.

ArtSquare personnel: ArtSquare personnel and authorized third-party consultants or contractors may have access to your personal information in the normal course of conducting ArtSquare business and providing the Site and Services to users.

Third-party providers: We may employ third-party companies and individuals to facilitate our Services, host the Site, provide the Services on our behalf, provide customer support, perform site-related services (such as maintenance services, database management, Web analytics, and improvement of the Site features) or to assist us in analyzing how our Site and Services are used. These third parties have access to your personally identifiable information only to perform these tasks on our behalf and are obligated not to disclose or use your personally identifiable information for any other purpose. We may store your information in locations outside the direct control of ArtSquare (for instance, on servers or databases co-located with hosting providers).

We use third-party payment processors to collect and store your payment card or bank account information and to process payments in connection with the Services. Any information that you provide to our payment processors is governed by each processor's separate privacy policy instead of this Privacy Policy. We encourage you to learn about the privacy practices of those third parties. ArtSquare neither collects nor stores your payment card or bank account information on its servers.

Business transfers: We may choose to reorganize, buy or sell assets, or undergo another type of business transaction, such as a merger, acquisition, stock sale, or other change of control. In these types of transactions, user information is typically one of the business assets that is transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets, business, company, or stock may continue to receive, store, use, disclose, protect, and process your personal information as set forth in this Privacy Policy.

Protection of ArtSquare and others: We may release personal information when we believe in good faith that release is necessary to comply with a law; to enforce or apply our Terms, this Privacy Policy and other policies; or to protect the rights, property, and safety of ArtSquare, our employees, our users, and others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

User Profile information: Information collected during registration and subsequent visits, such as your full name and location, may be publicly displayed in your User Profile, which is the area on ArtSquare where we allow you to tell other ArtSquare users about yourself. You may control what personal information is displayed in your User Profile by visiting the settings section of your User Profile.

Syndication: ArtSquare allows for the RSS syndication of all of its public content within the Site.

With your consent: Except as noted above, we will contact you when your personally identifiable information is shared with third parties or used for a purpose incompatible with the purpose(s) for which it was originally collected, and you will be able to opt out to prevent the sharing of this information via the contact information provided below.

We may aggregate and/or anonymize information collected through the Site so that the information does not identify you. We may use or disclose aggregated, anonymized and other non-personally identifiable information for any purpose, including for research and marketing purposes, and our use and disclosure of such information is not subject to restriction.

The Site may contain links to other Web sites, including social media sites. We are not responsible for the privacy practices of other sites and encourage users to be aware when they leave the Site and to read the privacy statements of such other sites. This Privacy Policy applies solely to information collected by ArtSquare via the Site and Services.

We use reasonable security measures to protect again the loss, misuse, or alteration of information that we have collected from you through our Site. Your ArtSquare account information is protected by a password for your privacy and security. Help protect against unauthorized access to your password by logging off once you have finished using a shared computer. Please note, however, that no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot guarantee absolute security.

As stated previously, you can always opt not to disclose information, but then you may be unable to use certain features on our Site. By visiting your User Profile, you can correct, amend, add or delete personal information.

You must be 18 years of age or older to register to use the ArtSquare Site. ArtSquare does not knowingly collect, use, or solicit personal information about or from children aged 13 or younger. If we learn that ArtSquare has collected information from a child aged 13 or younger, we will delete that information as quickly as possible.

ArtSquare may amend this Privacy Policy from time to time, at our sole discretion. If we make changes to the Privacy Policy, we will notify you by posting an announcement on the ArtSquare Site, sending a message to the e-mail address associated with your account, or by other means. Any revisions to this Privacy Policy shall become effective the earlier of (i) the seventh day after such revisions have been posted on the Site or (ii) your first use of the Site after such revisions have been posted.

If you decide to visit the Site, your visit and any possible dispute over privacy is subject to this Privacy Policy and our Terms, including limitations on damages, arbitration of disputes, and application of Texas law.
